Here is the latest update on the progress of Bill C53 which amends the
Pest Control Products act. As outlined below there are many
deficiencies in the proposed legislation and there is still an
opportunity to address them.

Bill C-53 has been rushed through the House and has passed first
reading
in the Senate on June 13, 2002. After 30 plus years, the proposed
'improvements/update' to the PCPA took only eighty-five (85) days from
start to finish. Some improvements were made during this first stage of
legislative review, but deficiencies remain that continue to place the
public and environment at risk.
The Senate adjourned for the summer on June 13, 2002 and second reading
of this bill is scheduled for September 17th . We do not know if the
C-53 will have several days or several weeks deliberation before the
expected prorogation of Parliament for the Queen's visit in
mid-October.
The legislative process in the Senate is similar to the House. After
second reading C-53 will go to a committee. Confirmation of which
committee will deal with Bill C-53 may not known until September. The
designated committee will receive all the submissions that were made to
the House Standing Committee on Health. For the most part, we can
expect
that Senators' staff will review the House information and conduct
their
own research. Like the House, we can expect public hearings -
especially
if public concern on deficiencies and necessary improvements are raised
across the summer. It is very important that our concerns and
suggestions for improvements with the current version of Bill C-53 be
clearly articulated and raised. Following the Senate Committee stage,
if
any amendments are made and these changes also pass the Senate vote,
the
Bill will be sent back to the House.
Some people working on the pesticide issue have accepted this Bill as a
good first step and are worried about continuing the fight to improve
the PCPA. We don't. It is the Minister of Health's duty and obligation
to protect the people of Canada. We must speak up after waiting 33
years
and given the growing scientific evidence on the risks of pesticide use
and the dangers posed to our children, our families, our communities,
our food supply, and the environment.
The mandate of the Bill (sec. 4.1) states: "In the administration of
this Act, the Minister's primary objective is to prevent unacceptable
risks to people and the environment from the USE of pest control
products."
Two amendments we are stressing are:
1) the introduction of a moratorium on the cosmetic use of chemical
pesticides [at minimum on all federal lands] and
2) the promotion of ecological alternatives.
Prepare for a major action campaign by September. In the meantime, if
you are able to contact/write any Senator listed below and discuss your
concerns with the Bill, as we have, it will start paving the way. In
addition to the two amendments above you can bring up the following
points:
[a) the need for comprehensive hearings - not a rush like the House -
too important an issue that needs real leadership and 'sober second
thought' to protect Canadians
(b) the need for C-53 to fully reflect the studies to-date &
recommendations, such as the Standing Committee on Environment And
Sustainable Development Report (May 2000)
(c) to enshrine precautionary principle throughout Act..
